This Master Agritourism, Eco-Lodging, and Guest Accommodation Rules Agreement (“House Rules”) structures the absolute operational regulations, codes of conduct, and physical liability waivers governing all short-term rentals, farm stays, homestays, eco-tourism projects, and silent retreats owned, managed, or listed by MittiMind Farms (“the Firm,” “Management,” “we,” “us,” or “our”). This includes our high-altitude wilderness properties in Laitnongrim near the Makham Valley parameters, as well as our residential rental units in Shillong, Meghalaya.
By transmitting a reservation deposit, completing a booking via any online or offline channel, signing a guest registry, or physically crossing the boundary lines of our properties, you (“the Guest,” “Visitor,” or “Traveler”), along with all accompanying minors and invitees in your booking party, enter into an absolute contract to adhere completely to these rules.
Your failure to thoroughly review or familiarize yourself with this document prior to your arrival date—regardless of interface oversight, digital haste, language translation anomalies, or lack of signature—does not exempt you from its restrictions or mitigate its total legal enforcement. If you object to any behavioral restriction, liability shift, or safety mandate detailed herein, you must immediately cancel your reservation request and refrain from entering our properties.
2. Booking Architecture, Financial Commitments, Security Deposits, and Cancellation Matrices
To preserve the fiscal stability of our remote, eco-stay hospitality model, all reservations are bound to the following financial frameworks:
- The Non-Refundability Standard: All advanced booking deposits, partial reservations, and full payment transactions are structurally non-refundable and non-transferable to alternative parties unless explicitly authorized in writing by a managing partner of the Firm.
- Mandatory Security & Incidental Damage Deposit: Management reserves the right to collect a mandatory security deposit prior to check-in or key handover. This deposit will be held as liquidity against physical room damage, appliance destruction, deep-cleaning requirements due to prohibited behaviors, or un-returned asset keys. The deposit will be refunded within forty-eight (48) hours post-checkout, contingent upon a comprehensive exit inspection by our onsite field managers or designated property caretakers.
- Weather-Induced Force Majeure and Booking Credits: Because our properties are located within mountainous and ecologically volatile environments, extreme monsoon rains, regional landslides, highway blockages, or state-mandated border closures may occasionally prevent physical safe transit. In such instances, MittiMind Farms is permanently absolved of cash-refund liabilities; the Firm will instead issue structural booking credits allowing the Guest to reschedule their stay within an expanded twelve-month window, subject to seasonal room availability.
3. Mandatory Regulatory Compliance and Identity Verification
MittiMind Farms strictly complies with all local, state, and national tourism laws, village council regulations (Dorbar Shnong standards), and internal security protocols.
- Mandatory Government Identification Archives: No guest or visitor will be permitted to enter or sleep on our properties without providing physical or digital copies of valid, government-issued photo identification cards (such as an Aadhaar Card, Passport, or Voter ID Card) for every single individual within the travel party. Driving licenses or corporate ID badges are not accepted as primary validation.
- Foreign National Tracking: Foreign nationals must explicitly present a valid Visa and Passport along with completing a formal registration file prior to cross-boundary entry, as mandated by regional regional administrative directives.
- Right of Entry Refusal: Management, onsite field caretakers, or authorized partners reserve the absolute, unreviewable right to refuse entry to any booking party that fails to satisfy identity verification protocols, registers fewer individuals than are physically present, or attempts to host unauthorized local day-guests without explicit, pre-arranged written clearance.
4. Inherent Geographic Hazards, Wilderness Realities, and Medical Emergency Waivers
Our properties are designed as rustic, off-grid eco-escapes, prioritizing authentic immersion in the mountainous landscapes of Northeast India. Guests explicitly acknowledge that this type of tourism carries inherent physical risks that cannot be eliminated by the Firm.
- Assumption of Premises Risk: You acknowledge that our properties feature natural, uneven high-altitude terrain, raw gravel footpaths, unpaved paths, cliffside viewing points, and proximity to native forest flora and wild fauna. The Guest assumes 100% of the physical risk of walking, sleeping, or navigating these terrains. MittiMind Farms, its registered partners, and property caretakers are completely insulated from claims of premises liability, including personal injury lawsuits resulting from trips, falls, weather-induced slips, wildlife encounters, insect bites, or changing climate effects.
- Extreme Medical Transit and Evacuation Delay Waiver: Due to the isolated geographical positioning of our farm stays, immediate proximity to modern multi-specialty hospitals, emergency rooms, or trauma facilities is unavailable. Transport to urban medical care (such as facilities in Shillong or Guwahati) requires navigating winding mountain roads prone to weather delays. The Guest explicitly acknowledges that emergency medical responses, ambulance dispatches, or health evacuations may be heavily delayed or entirely blocked by distance and infrastructure realities. You irrevocably release MittiMind Farms, its partners, property owners, and field staff from any liability regarding the escalation of medical conditions, accidental physical complications, permanent disabilities, or death arising from transit or evacuation delays.
5. Off-Grid Operational Infrastructure and Utility Limitations
To minimize ecological footprints, our farm stays utilize sensitive, decentralized, and asset-lite infrastructure systems.
- Acceptance of Native Utilities: Guests acknowledge that our utility structures rely heavily on regional environmental variables. This includes solar power arrays for electricity, natural mountain spring water networks, and remote cellular towers for communication.
- Exclusion of Utility Compensation Claims: Temporary or extended disruptions in localized utility frameworks—including drops in solar battery reserves due to prolonged cloud cover, variations in mountain spring water pressure, lack of water heating capabilities during cold weather anomalies, or zero-bar cellular network coverage drops—are native characteristics of the remote eco-stay environment. These occurrences do not constitute a breach of service by the Firm, do not represent property defects, and absolutely do not entitle the Guest to financial refunds, room upgrades, booking cancellations, or subsequent legal compensation.
6. On-Property Code of Conduct, Prohibited Activities, and Cultural Respect
MittiMind Farms operates as a collection of “silent farm stays,” focused on peace, sustainability, and mutual community alignment. We enforce a zero-tolerance policy against disruptive behaviors.
- Preservation of Quiet Hours and Contentious Audio: To maintain the sensory environment of our silent retreats, strict quiet hours are enforced between 10:00 PM and 6:00 AM daily. The operation of external Bluetooth speakers, high-decibel audio setups, or shouting within shared farm sectors or open balconies is strictly prohibited during these windows. At all other times, audio volumes must be kept inside individual rooms so as not to disrupt neighboring travelers or local agrarian staff.
- Strict Prohibitions on Illicit Substances & Weapons: The introduction, possession, sale, or consumption of illegal narcotics, psychoactive substances, un-prescribed chemical compounds, or unregistered firearms on our properties is entirely forbidden. Any violation will result in immediate, non-negotiable expulsion and direct reporting to local law enforcement authorities.
- Respect for Regional Local Community Customs: Our properties sit in proximity to traditional local communities and agricultural ecosystems. Guests are required to dress modestly when stepping outside active lodging perimeters and to interact with our local tribal staff, field operators, and neighboring community members with dignity and respect. Any guest exhibiting discriminatory speech, aggressive body language, or culturally offensive behaviors will be handled via the immediate eviction procedures detailed in Section 8.
- Strict Non-Smoking and Open Fire Mandates: Smoking tobacco, vaping, or utilizing e-cigarettes is entirely forbidden inside any indoor structures, wooden cabins, or basement units. Smoking is restricted exclusively to designated, outdoor gravel fire-pits. Guests are strictly prohibited from lighting independent open bonfires or burning trash inside our agricultural or forest zones due to severe wildfire threats to our crops and properties.
7. Property Damage, Asset Destruction, and Financial Indemnification
The Guest assumes full individual and joint financial liability for preserving the structural and mechanical integrity of all accommodations, furniture elements, linens, and farming infrastructure during their stay.
- Farming Zone and Crop Protection Boundaries: Guests are encouraged to explore our agricultural spaces but are strictly forbidden from harvesting, picking, trampling, or altering our premium mushroom beds, microgreen setups, drying infrastructure, or experimental agricultural crops without the direct accompaniment and written consent of an authorized field manager.
- Restitution for Damage: If a guest destroys property, stains fabrics beyond standard laundry extraction, breaks electronic appliances, damages shared farming tools, or causes structural harm to our eco-stay buildings, the primary booking contact will be billed directly for the total replacement cost of the items, along with local transport freight charges and lost operational revenue caused by taking the room offline. The Firm reserves the right to charge these fees directly to the credit card or security deposit on file.
8. Unconditional Right of Expulsion and Eviction Authority
MittiMind Farms, through its managing partners, onsite property owners, or designated field caretakers, retains an unconditional, absolute, and unreviewable authority to execute immediate room evictions against any guest or travel group.
- Triggers for Immediate Eviction: This right of expulsion will be enforced if a guest explicitly violates our quiet hours, damages farm infrastructure, abuses our caretakers, inputs unverified guests, uses illegal substances, or engages in behaviors that threaten the physical safety or peace of our workers or fellow travelers.
- Total Forfeiture of Fees: Upon the verbal or written execution of an eviction directive by Management, the Guest’s accommodation license is instantly revoked. The Guest must pack their personal effects and exit the property boundaries within thirty (30) minutes of notice. Evicted parties forfeit 100% of all paid booking fees, security deposits, and incidental balances, and the Firm is entirely absolved of any downstream liabilities, including finding alternative lodging or covering emergency transport logistics for the evicted individuals.
9. Governing Law and Exclusive Dispute Jurisdiction
These House Rules, along with your entire physical and digital relationship with MittiMind Farms, shall be governed by, interpreted, and construed strictly in accordance with the laws of India, without regard to choice of law principles.
Any legal dispute, controversy, claim, or premises liability action arising out of or in connection with these rules—including disputes relating to booking cancellations, property damage, or personal injuries sustained during a stay in Northeast India—shall be submitted to the exclusive jurisdiction of the competent courts located in Guwahati, Assam, India, where the Firm maintains its primary professional business operations. The Guest explicitly waives any right to object to this venue or to assert that such courts constitute an inconvenient forum.
